Are short-barreled rifles legal in Arizona? (2026)
Arizona lists short-barreled rifles as "prohibited weapons," but the definition excludes firearms "possessed, manufactured or transferred in compliance with federal law." The exception says "compliance," not "registered," which is why Arizona is a state to watch after ATF's October 9, 2026 change.
The short answer
- SBRs are "prohibited weapons" under A.R.S. § 13-3101(A)(8)(a)(iv).
- Exception: subsection (B) says the term does not include firearms "possessed, manufactured or transferred in compliance with federal law."
- Penalty: class 4 felony under § 13-3102.
- Official Arizona Attorney General guidance after October 9: Not yet verified.
The statute
Section 13-3101(A)(8)(a)(iv) includes in "prohibited weapon":
"A rifle with a barrel length of less than sixteen inches, or shotgun with a barrel length of less than eighteen inches, or any firearm that is made from a rifle or shotgun and that, as modified, has an overall length of less than twenty-six inches."
Subsection (B) says these items "do not include any firearms or devices that are possessed, manufactured or transferred in compliance with federal law." Read A.R.S. 13-3101. Section 13-3102(A)(3) covers "Manufacturing, possessing, transporting, selling or transferring a prohibited weapon." Subsection (F) has an exception for an authorized manufacturer's or dealer's merchandise.
How Arizona defines an SBR
Arizona doesn't use the term SBR. It uses the same numbers as federal law: a rifle with a barrel under 16 inches, or a firearm made from a rifle with an overall length under 26 inches. See 26 U.S.C. 5845 for the federal definition.
Penalty
Under § 13-3102(M), a violation of paragraph 3 of subsection (A) is a class 4 felony.
Is legality tied to federal registration?
The wording is "in compliance with federal law," not "registered." ATF's October 9, 2026 open letter says it stopped enforcing Form 1 and Form 4 approval and registration for SBRs, SBSs, suppressors and AOWs, and voluntary forms are still processed. Whether an unregistered SBR is "in compliance with federal law" for Arizona purposes: Not yet verified. We found no official Arizona Attorney General guidance.
Our Arizona suppressor guide reports how two Arizona dealers are handling SBRs: Firearms Unknown (Yuma) transfers them on a Form 4473 without NFA registration, while CDC Arms (Fort Mohave) is keeping SBRs on the Form 4 for now. SB 1069 (2026), which was vetoed June 19, 2026, dealt with suppressors only.
Hunting
A.R.S. 17-251 is about silencers. Its subsection (B) says: "This section does not limit the authority of the commission to prescribe the type and caliber of firearm or ammunition that may be used for taking wildlife." SBR-specific hunting rules: Not yet verified.
Other laws that interact
Section 13-3101(A)(8) covers other items on the same prohibited-weapon list, and § 13-3102 has additional subsections beyond those cited here. Other Arizona laws that might affect SBR owners: Not yet verified.
Braced pistols
The state statutes cited here don't mention pistol braces.
Federal process in 2026
- The making and transfer tax on SBRs has been $0 since January 1, 2026.
- ATF stopped Form 1 and Form 4 enforcement on October 9. Voluntary forms are still processed. See NFA wait times.
- Dealers use a Form 4473 and NICS check. ATF won't enforce 18 U.S.C. 922(b)(4) "Until final rules are issued."
- "For now," interstate transport still needs an approved Form 20 (18 U.S.C. 922(a)(4)).
- A dealer can't sell where state law forbids it (18 U.S.C. 922(b)(2)).
ATF says there is no automatic grandfathering if enforcement resumes. Full detail is on our SBR rules 2026 page, and you can compare states with the state NFA checker.
