Are short-barreled rifles legal in Maine? (2026)
We found no Maine statute that bans or regulates short-barreled rifles. Title 17-A, chapter 43, the state's weapons chapter, covers machine guns and a handful of other items, but it has no SBR or short-barreled shotgun provision. Federal rules still apply, and this page covers both. We read the chapter's section list and the machine gun exemption, not every section in the Maine Revised Statutes, so confirm with an attorney before you build or buy one.
The short answer
- No SBR provision found. Chapter 43 of Title 17-A (sections 1051 to 1060) has no short-barreled rifle or shotgun offense in the sections we read.
- No state registration tie found. With no state SBR offense, nothing we found makes ownership depend on NFA registration.
- Penalty under state law: None found.
- Not fully verified. We did not search the rest of the Maine Revised Statutes, so treat Maine's SBR status as unconfirmed and check with an attorney.
- Federal law still applies. See "Federal process in 2026" below.
The statute
The place to look is the Maine Legislature's page for Title 17-A, chapter 43, which is titled "WEAPONS." It lists these sections: possession of a machine gun, the right to possess, carry or transport a machine gun, confiscation and seizure of a machine gun, forfeiture of a machine gun, a repealed section on dangerous knives, armor-piercing ammunition, firearms in establishments licensed for on-premises consumption of liquor, firearms in a courthouse, firearms in a correctional facility or jail, and undetectable firearms.
We found no SBR provision in the sections we read. The closest thing to a federal tie is in the machine gun section on the right to possess, carry or transport (ยง 1052), which says:
"Machine guns manufactured, acquired, transferred or possessed in accordance with the National Firearms Act, as amended, shall be exempt from this chapter."
That sentence is about machine guns. It does not mention rifles with short barrels.
How Maine defines an SBR
The Maine statutes we read have no SBR definition. Federal law (26 U.S.C. 5845) draws the lines: a rifle with a barrel under 16 inches, or a weapon made from a rifle with an overall length under 26 inches.
Penalty
None found. Because we found no Maine SBR offense, we have no state penalty to report for one. The machine gun, armor-piercing ammunition and other chapter 43 offenses carry their own penalties, which we did not review for this page.
Is legality tied to federal registration?
For SBRs, we found no state text that refers to federal law or registration. The only NFA reference we found in chapter 43 is the machine gun exemption quoted above: "Machine guns manufactured, acquired, transferred or possessed in accordance with the National Firearms Act, as amended, shall be exempt from this chapter."
ATF's October 9, 2026 open letter says it stopped enforcing Form 1 and Form 4 approval and registration for SBRs, SBSs, suppressors and AOWs. Voluntary forms are still processed. Since we found no Maine SBR offense, we found no state registration requirement for that change to collide with. How Maine would treat an unregistered SBR: Not yet verified.
We found no Maine Attorney General or state police statement on SBRs or on ATF's October 9 change. Our Maine suppressor guide covers the related suppressor questions in the same chapter.
Hunting
SBR-specific hunting rules: Not yet verified. Per our suppressor guide, Maine's statutory bar on suppressors for hunting was repealed in 2021, but a hunter convicted of certain listed violations while carrying a firearm with a sound-suppression device faces a license suspension of at least three years.
Other laws that interact
- Machine guns: chapter 43 covers them separately, with the NFA exemption described above. An SBR is not a machine gun, so that section does not apply to it.
- Places where firearms are restricted: chapter 43 has sections on firearms in liquor-licensed establishments, courthouses, and correctional facilities or jails. We did not read those sections for SBR-specific wording.
- Undetectable firearms: section 1060 is titled "Undetectable firearms prohibited." We did not read its text for this page.
- Minors, concealment, manufacturing and CLEO certification: Not yet verified.
- Local rules: discharge restrictions in a town, lease terms and federal land rules apply no matter what the criminal code says.
Braced pistols
The state statutes cited here don't mention pistol braces. For the federal side, see our pistol brace guide.
Federal process in 2026
- The making and transfer tax on SBRs has been $0 since January 1, 2026.
- ATF stopped Form 1 and Form 4 enforcement on October 9. Voluntary forms are still processed. See NFA wait times.
- Dealers use a Form 4473 and NICS check. ATF won't enforce 18 U.S.C. 922(b)(4) "Until final rules are issued."
- "For now," interstate transport still needs an approved Form 20 (18 U.S.C. 922(a)(4)).
- A dealer can't sell where state law forbids it (18 U.S.C. 922(b)(2)).
ATF says there is no automatic grandfathering if enforcement resumes. Full detail is on our SBR rules 2026 page, and you can compare states with the state NFA checker.
