Are short-barreled rifles legal in Vermont? (2026)

We found no short-barreled rifle provision in Vermont's weapons chapter. We read 13 V.S.A. chapter 85 and searched it for the usual SBR wording, and the only NFA-style item it regulates is the gun suppressor. Federal rules still apply, and this page covers both. Confirm with an attorney if your situation is unusual.

Not legal advice. This page summarizes Vermont statutes and federal guidance as of the date above. Local rules and your own circumstances can matter. Check with your dealer or a Vermont attorney if you're unsure.

The short answer

The statute

We found no SBR provision in the sections we read. The closest NFA-type rule in the chapter is 13 V.S.A. § 4010, which covers gun suppressors. It shows what the chapter does regulate:

"A person shall not manufacture, make, or import a gun suppressor, except for:"

"A person shall not use a gun suppressor in the State, except for use by:"

Nothing in that section reaches a rifle with a short barrel. Neighboring sections deal with other conduct. For example, § 4011 covers pointing or aiming a gun at another person, and § 4009 covers negligent use.

How Vermont defines an SBR

The state statutes we read have no SBR definition. Federal law does: a rifle with a barrel under 16 inches, or a weapon made from a rifle with an overall length under 26 inches (26 U.S.C. 5845).

Penalty

We found no SBR-specific offense in Vermont, so there is no state SBR penalty to report. The penalties in § 4010(d) apply to suppressors. Federal penalties are not covered on this page.

Is legality tied to federal registration?

Not for SBRs, because the state text we read doesn't mention them. The only federal reference in § 4010 concerns suppressors. Subsection (b)(3) excuses a home maker who acts in compliance with 26 U.S.C. § 5822, the federal making provision.

ATF's October 9, 2026 open letter says it stopped enforcing Form 1 and Form 4 approval and registration for SBRs, SBSs, suppressors and AOWs. Voluntary forms are still processed. Since Vermont has no SBR provision, there is no state wording that depends on registration for an SBR. How the suppressor-making wording applies after October 9 is untested. Our Vermont suppressor guide covers that question. We found no Vermont Attorney General statement on it.

Hunting

SBR-specific hunting rules: Not yet verified. Per our suppressor guide, suppressor use is allowed when taking game in Vermont under 10 V.S.A. 4701(d).

Other laws that interact

The chapter has general conduct rules that apply to any firearm. Section 4011 says that "Any person who shall intentionally point or aim any gun, pistol, or other firearm at or towards another, except in self-defense or in the lawful discharge of official duty, shall be punished by fine not exceeding $50.00."

Section 4009 says that "A person who carelessly or negligently wounds another person by gunshot shall be imprisoned not more than five years or fined not more than $1,000.00, or both."

We did not review local ordinances, discharge restrictions or rules on state and federal land for this page. Not yet verified. Vermont has no state CLEO certification rule that we found in the material we read, but that is Not yet verified as well.

Braced pistols

The state statutes cited here don't mention pistol braces. See our pistol brace guide for the federal picture.

Federal process in 2026

ATF says there is no automatic grandfathering if enforcement resumes. Full detail is on our SBR rules 2026 page, and you can compare states with the state NFA checker.

Frequently asked questions

Are short-barreled rifles legal in Vermont?
We found no short-barreled rifle or shotgun provision in 13 V.S.A. chapter 85 (Weapons), sections 4001 to 4084. Federal rules still apply, including Form 20 approval before taking an SBR across state lines. Confirm with an attorney.
Does Vermont define a short-barreled rifle?
Not in the sections we read. Federal law, 26 U.S.C. 5845, uses a 16-inch barrel line and a 26-inch overall length line.
Does Vermont require NFA registration for an SBR?
The Vermont text we read has no SBR provision, so it does not tie SBR legality to registration. Section 4010 refers to federal law only for suppressors.
Can you hunt with an SBR in Vermont?
SBR-specific hunting rules are not yet verified. Our suppressor guide notes that suppressor use while taking game is allowed under 10 V.S.A. 4701(d).

According to ATF's fact sheet, "For now," transporting an SBR across state lines still requires an approved Form 20.
